Sports streamer Fubo is reportedly suing Disney, Fox Corp. and Warner Bros. Discovery over the planned sports streaming bundle the trio of companies announced earlier this month.
The Wall Street Journal, Variety and Business Wire all report that in an antitrust lawsuit filed Tuesday, Fubo alleges that the Defendants have engaged in a long-running pattern of stymying Fubo’s service by engaging in anti-competitive practices.
Such tactics reportedly include unfair bundling, non-market penetration requirements, and Fubo allegedly being charged content licensing rates at 50% or more higher than rates they charge other distributors.
Fubo believes it has incurred billions of dollars in damages as a result of the Defendants’ actions.
In its complaint, Fubo reportedly seeks to block the joint venture or alternatively require restrictions on the defendants in order to proceed such as “economic parity of licensing terms”. Fubo also seeks “substantial” monetary damages.
Announced two weeks ago, the Disney/Fox/Warners joint venture is aiming to launch in the Fall and will include ESPN+ along with streaming feeds of fourteen linear TV networks: ESPN, ESPN2, ESPNU, SECN, ACCN, ESPNews, ABC, Fox, FS1, FS2, Big Ten Network, TNT, TBS and truTV.
The streaming bundle will be available from the currently unnamed joint venture, as well as an add-on via services like Disney+, Hulu and Max.
