Just weeks after a lawsuit concerning the international release of James Gunn’s “Superman” was dismissed, Puck News reports that the same lawsuit has been re-filed in New York state court.
The estate of the character’s co-creator Joseph Shuster filed the original lawsuit back in January, claiming infringement of copyright laws in the U.K. Australia, Canada and Ireland.
If it had gone forward, it could’ve potentially impacted the release of the new “Superman” film in those countries. However, a judge dismissed it, citing a “lack of jurisdiction over the case”.
Now, attorney Marc Toberoff is hoping to get the matter resolved with this refiling and asking for an injunction – thus potentially stopping the film’s release in various foreign markets.
Last week, a New York Supreme Court judge ordered Warners to submit opposition papers by Friday this week and appear in court on June 4th to explain why an injunction shouldn’t be granted.
The news comes as “Superman” is set to be Warners’ big earner this Summer.
