As you no doubt know, Gina Carano is taking Lucasfilm and Disney to court over her sacking from The Mandalorian. Carano was let go from the series, and her role, in early 2021 after a social media post that Lucasfilm interpreted as Carano comparing holding Republican views and political positions with being Jewish during the Holocaust.

Her filing argues that the company unlawfully retaliated against her for expressing her personal political views that were out of step with Disney’s prevailing internal ideology. California law prohibiting employers from retaliating against employees for political activity.

In retaliation, Disney lawyers filed a motion on Tuesday to throw out the lawsuit. They argue that Disney has:

“…a constitutional right not to associate its artistic expression with Carano’s speech.”

Disney’s filing states that there is a broad exception to these California laws for companies whose business is to engage in speech like newspapers and entertainment companies.

The company cannot hide from its methods and reasons, as it put out a statement the same day she was fired, referring to her comments as:

“…abhorrent and unacceptable…”

They also made it clear they will not work with Carano again on any projects. So it all comes down to whether they can legally fire somebody for their political views, and where free speech starts and stops in relation to corporate control and image.

X owner Elon Musk is funding Carano’s lawsuit against Disney.
